Legal Challenge Delays Construction of Largo Inviolata Roundabout

Currently, along Largo Inviolata, a race against time is in progress. Co.vi.bas has filed a lawsuit on December 22nd, signed by lawyer Vanni Ceola, requesting a suspension of the construction of the roundabout, which has already commenced.

At the hearing on January 11th, the first after the end-of-year recess, the administrative court judges will consider the suspension request, postponing the decision on the substantive issues raised by the plaintiffs and the administration to a later date.

If they were to accept the petition, they would order the halt of the construction site until the ruling, which could mean a few months: however, until next Thursday, the Martinatti company continues to work.

TRAFFIC CHANGES AND PROJECTS

By that date, Via Baruffaldi should be reopened, now to traffic flowing in the opposite direction from the past, i.e., from west to east, from Inviolata towards Viale Martiri.

Indeed, after completing the construction of the flowerbed in front of the conservatory, the company must now proceed with working in the middle of Largo Inviolata.

To do this, the current traffic flows need to be redirected. Specifically, all vehicles coming from Viale Trento and heading to the city center, instead of descending via Viale Madruzzo or going straight along Via Roma, will turn left onto Viale Baruffaldi and then right onto Viale Martiri.

On this avenue, only the final section will remain one-way towards the north. Behind the «cuts» of Inviolata, the direction will change, with cars heading south towards the bus stop and the Livio bar intersection.

The work management has also planned to restart the traffic light at the intersection with Viale Madruzzo, which is currently on a steady yellow because there are no overlapping traffic flows there.

With the new regulations, however, the situation will change: cars descending from Viale Madruzzo will also come from the left flank, similar to when the avenue was two-way.

LEGAL ISSUES AND THE ADMINISTRATION’S POSITION

The Covibas claims in its lawsuit that the resolution by which the municipal council approved the reconstruction of the roundabout is unlawful because the roundabout is only provided for in the PRG (urban development plan), which despite having had two adoptions, has not yet been definitively approved by the Provincial Council and therefore is not in force.

Until that day, the urban planning instrument remains the district plan, under which the roundabout would not be permitted.

The council does not agree and also references the recently approved traffic plan, in which the roundabout is included.
