Legambiente Challenges Upper Garda Plan Review Committee Validity

The validity of the Technical-Scientific Committee currently reviewing the Territorial Coordination Plan of Upper Garda has once again been challenged by Legambiente, which recently filed an appeal with the TAR. The appeal raises “strong doubts about the legitimacy of the decisions,” asserting that “the Committee must be composed of experts with high qualifications in naturalistic, landscape, and agro-forestry disciplines. Among these, there must be at least an architect, a botanist, a zoologist, an agronomist, and a representative of the Regional Forest Agency.”

Criticisms and Requirements of the Committee

However, “the organization does not include any professional or academic figure with expertise in fauna, agriculture, or botany.” The appeal was preceded in June by a report to the Minister of the Environment Willer Bordon, the Regional Environmental Assessor Franco Nicoli Cristiani, and Bruno Faustini, president of the Upper Garda Park Community. The same criticisms apply.

According to Legambiente, in short, the required expertise as stipulated by both the park’s founding law and the Statute of the Organization does not exist. “Fleeting,” recalls the association, “are a professional appointed by the Municipality of Limone; Zanelli from the one in Toscolano; Salvadori is a member of the Building Commission in Salò; Molgora is on the Building Commission in Gargnano.” b.f.
