Padenghe Implements New Port Management Regulations on Brescia Shoreline

The Comune di Padenghe holds the primacy in implementing the new regulations concerning the transfer of port management, following the regional law of October 28, 1998, which delegated municipalities the authority to assign administrative functions regarding navigation and public waters within inland waters.

Last evening, the City Council approved the regulation for the highly debated allocation of aquatic spaces for temporary occupation in the port of Villa Garuti.

Over the years, numerous mechanisms have been implemented to avoid clientelistic allocations, but each time the problem reemerged. This was also due to the chronic lack of boat slips in public areas, with costs significantly lower than private moorings or privately managed ports.

Now, with the new framework, the management will directly pass to the Municipalities, which will regulate the matter. Padenghe, as far as we know, was the first on the Brescia shoreline to adopt its own regulation.

Norms and allocation procedures

Among the various norms, the duration is set at two years, starting from January 1, 2001. In the port of Villa Garuti, 43 mooring modules or docks are available, with different sizes, and will have an annual cost varying depending on the size of the module, starting from 396,000 lire for a 6 by 2-meter space up to a maximum of 1,155,000 lire for a 10×3.50-meter module.

Allocations will follow «precedence» rules established in the regulation, such as reserving 20% of the total spots for residents of the Comune who have been living there for at least 5 years; and one spot for public services or emergency.

Applications, on official stamped paper costing L. 20,000, to obtain the boat slip concession, must be submitted between July 1 and August 31, 2000.

Allocations will be granted in the order of submission until spots are exhausted, and successful applicants will receive a special permit to display visibly on their vessel.

Of course, the transfer of mooring spots or exchanges between permit holders will not be permitted. Changing the vessel stated in the application is also prohibited.

As before, the ports will not be supervised, and no liability for thefts or damages can be attributed to the Comune.

For unauthorized users, forced removal will be enforced, with charges to cover expenses incurred by the public administration.

Finally, moorings numbered 49, 50, and 51 will be reserved for hourly parking; spot number 52 will be reserved for vessels in navigation facing difficulty due to exceptional weather events.
