Court Blocks Lonato Waste Incinerator Plan Due to Unconstitutional Approval

The Constitutional Court “freezes” the Lonato di Garda (Brescia) master plan and makes the future of the waste incinerator uncertain. In 1994, the Leagues-led council invoked the so-called “silent approval” to speed up the plan’s approval by the Regione Lombardia: if no response was given within 180 days, the plan was considered approved. The Court has now deemed the clause in the financial law that authorized silent approval unconstitutional.
