Roma Court Upholds Pedestrian Zone in Sirmione Center
The resolution regarding restricted traffic and pedestrianization of the historic center is lawful. No limitations are observed concerning residents. This is, in summary, the core of the ruling by the Consiglio di Stato di Roma, which upheld the appeal of the Comune di Sirmione to annul the Tar di Brescia decision, which had previously favored the owners of the Hotel «Eden» (located in the very central Piazza Carducci), who felt penalized by the pedestrianization implemented by the administration.
Although the same administration had granted exceptions for vehicle access to the hotel, the legal dispute continued. If the resolution establishing the “pedestrian zone” were overturned, the Comune di Sirmione would find itself in an uncomfortable position.
Implications and reflections on traffic management
One might logically ask how the entire traffic system in the historic center could have been regulated amid significant noise and environmental pollution issues. The managers of Eden had, for their part, complained about numerous inconveniences and potential economic damages caused by the difficulties faced by customers in reaching or leaving Piazza Carducci.
In contrast, the Comune has initiated the electrification process in the historic center, the first step towards the complete pedestrianization of the old town. Additionally, allowing vehicle passage in Piazza Carducci could have jeopardized other commercial activities (bars, restaurants, ice cream shops) located there.
Finally, the decision by the Tar went beyond the private individual’s requests, permitting vehicular access at any time of day without verifying the purpose of entry.
