Murder in Mantova: Dumitru Stratan and the contested premeditation

The Mantova Prosecutor’s Office has initiated an appeal against the conviction of Dumitru Stratan, the ex-boyfriend of the victim Yana Malaiko, who was sentenced to twenty years in prison for murder. Yana, a 23-year-old Ukrainian, was tragically suffocated and strangled in January 2023. Although the Court of Assizes did not recognize premeditation, the prosecution argues that the details of the murder indicate a well-conceived plan. Stratan’s threats began five days prior to the crime, and his harassing behavior is supported by evidence such as online searches for methods to poison someone.

Yana’s body was discovered ten days after the crime, while Stratan, initially evasive, was implicated through video footage and messages. The prosecution contests the Court’s interpretation regarding the spontaneity of the killer, asserting that there was latent hatred that culminated in a premeditated murder plot disguised by the clumsiness of his actions. According to legal precedents, even decisions made shortly before the crime can constitute premeditation. The case remains open pending the outcome of the appeal.
