Sirmione and Tourist Locations: the Overtourism Issue
The Council of State has referred the decision regarding tourist rentals in Sirmione back to the T.A.R. of Brescia with ordinance no. 3321 dated September 12, 2025, urging the court to clarify its stance on the authority of municipalities to regulate short-term rentals. This case arose in response to the increasing phenomenon of uncontrolled rentals that threaten the urban planning of the area, complicating access to housing for residents and workers, and negatively impacting traffic and social life in the historic center.
The municipal administration has emphasized the importance of regulating the sector to protect residents, visitors, and the local cultural heritage, highlighting that this initiative is part of a broader discussion on overtourism that also involves other cities such as Verona. Mayor Luisa Lavelli expressed confidence that the T.A.R. will reaffirm the legal support for municipalities in their fight against the effects of overtourism, aiming to maintain a high quality of the tourism offering in the region.
