TAR Upholds Sirmione’s 2022 Short-Term Rental Regulations
Sirmione’s municipal government confirms the validity of its 2022 regulation governing short-term tourist rentals, following a December 2025 ruling by the Regional Administrative Court of Brescia (T.A.R. Lombardia). The court upheld the regulation’s requirements, including parking availability, technical system compliance, and verification of property conditions relative to cadastral surface area. Additionally, the Court rejected a private party’s request for suspension, affirming that activity suspension due to missing essential certifications, such as electrical conformity, is justified.
The ruling aligns with a December 2025 Constitutional Court decision clarifying that regional and local authorities are responsible for regulating short-term rentals to protect public interests. Sirmione, which sees over 1.2 million annual visitors, states that the regulation aims to address urban and public order concerns, with Mayor Luisa Lavelli emphasizing the importance of clear rules for integrating short-term rentals into the local framework.
