Lacisiese Municipality Sets Compensation for Illegal Construction Near Protected Areas

At least two billion lire will flow into the municipal coffers with the application of the compensation indemnity for illegal constructions carried out in environmentally protected areas. This amount must be used by the municipal administration for environmental safeguarding and territorial recovery purposes.

It should be emphasized that the Comune lacisiense is among the first in the province to have established the parameters and procedures, as provided by law, for quantifying the indemnity to be applied to any illegal intervention that has been regularized through a building permit in a sanatoria.

Decisions of the City Council

However, in an effort to avoid harmful legal disputes, the City Council has resolved not to apply the increases proposed by the Provincial Department of Environmental Resources and Urban Planning but to maintain the percentage set by the Ministerial Decree of 3 percent based on the ordinary profit from the estimated value of the property for the three main types of violations, whether compliant or non-compliant with protection regulations.

Furthermore, the Council has decided to apply the profit value at the minimum amount of one million lire for violation type 4, 750,000 lire for types 5 and 6, and half a million lire for violation type 7.

Estimated value and real estate destinations

The estimated value for properties within the municipal territory has been set at 1,383,000 lire per square meter of gross surface for residential and other activities, and at 829,800 lire (60 percent) per square meter of gross surface for accessories of any destination.
