Legal Challenges Halt Lungolago Project Amid Municipal Disputes

Yesterday morning, a copy of the announced appeal filed with the Tar di Brescia was delivered at the Municipio di Desenzano by a group of citizens assisted by lawyer Paolo Zenoglio.

And already today, the document contesting the procedures chosen for the selection of the professional firm tasked with redesigning the controversial Lungolago Battisti will be analyzed by the lawyers defending the municipal administration before the administrative courts.

This is the second major obstacle encountered by the project launched at the beginning of last January, which has already faced a further setback: the cancellation order of the same project, notified in recent days to Mayor Cino Anelli by the Sovrintendenza ai beni ambientali e architettonici di Brescia.

Minority Interventions and Risk of Damage

Now, the situation is further stirred up by the initiative of minority municipal councilors, who have requested the convening of an extraordinary city council meeting and the formation of a special commission to “verify the correctness of the procedures adopted so far, as well as those the administration will choose for the completion of the works”.

The request, submitted yesterday, is signed by councilors Abbadini, Abate, Raldiri, Polloni, Menegato, Bertoni, Francoli, Pienazza, and Turrini.

The text specifically recalls that there is a formal warning sent by a lawyer on behalf of a group of citizens, that the Sovrintendenza has revoked the authorization granted by the mayor for the Lungolago works, and that finally, “prolonged suspensions of the works or modifications to the project would cause serious economic damages to the municipal entity and to the commercial and hotel activities in the historic center”.

The council president, after listening to the group leaders and the Giunta, will surely decide on this matter. In particular, on the request to establish the special commission made by the opposition.
