Sirmione and tourist accommodations: the Council of State intervenes

The Council of State has recently referred to the TAR the decision regarding tourist rentals in Sirmione, one of the main locations on the Lake Garda. With ordinance no. 3321 dated September 12, 2025, the Council has asked the Regional Administrative Court of Brescia to clarify its previous rulings on the power of municipalities to regulate short-term rentals. This intervention comes in the context of growing concerns over the uncontrolled proliferation of tourist rentals, which, according to the municipal administration, threatens the urban planning and quality of life for both residents and tourists.

Mayor Luisa Lavelli expressed confidence that the TAR will recognize the need to regulate the sector, highlighting that this initiative is part of a broader debate on overtourism that also involves other Italian cities. The case will therefore proceed at the TAR, where a thorough assessment of the regulations concerning tourist rentals and their impact on Sirmione and its residents is anticipated.
