The Court of Assizes of Appeal in Brescia has upheld the acquittal of Samuele Freddi’s friend from the charge of unintentional homicide. Samuele, a young man, passed away at the age of 21 in July 2021 due to a cerebral hemorrhage at his home in San Felice del Benaco. On the evening before his death, the two young men had an argument following a minor car accident, during which Samuele was slapped several times. Despite complaining of a headache afterward and being admitted to the emergency room, he signed himself out voluntarily and returned home, where his condition rapidly deteriorated.
The attorney general had requested a sentence of 4 years and 5 months, arguing that the assault was the cause of the fatal hemorrhage. However, the judges found the evidence insufficient to establish a causal link between the altercation and the death. The defense pointed out that the defendant did not recall any falls or visible trauma, and that an expert report had revealed a pre-existing vascular condition in Samuele. The reasons for the ruling will be made known within ninety days.
