Sirmione: TAR and Council of State Confirm Regulations on Short-Term Rentals and Public Premises
Two court rulings have upheld Sirmione’s rules on short-term rentals and in areas with traffic and parking challenges, reinforcing the municipality’s strategy to curb overtourism. On April 22, 2026, the TAR Lombardia (Brescia section) rejected a private challenge to the 2022 Regulation on tourist accommodations; two days later, April 24, the Council of State confirmed the Regulation governing new food and beverage venues in critical zones.
The TAR’s decision (Ruling no. 560) validated the tourist rentals regulation, noting the respondent failed to propose adequate parking solutions and other required measures. Key prerequisites upheld include parking or equivalent provision, proper technical and safety compliance, hygienic and energetic standards, alignment of capacity with cadastral surface, and the absence of abusive practices. On April 24, the Council of State (Ruling no. 3202) likewise cleared the food-and-beverage regulation, enabling openings in areas with mobility issues and limited parking as part of the city’s safeguards against tourism-related impacts.
Together with a broader strategy targeting roughly 1.4 million annual tourist stays, the rulings echo jurisprudence supporting local regulation of short-term rentals to protect residents and services. Lombardia’s tourism assessor Debora Massari welcomed the TAR decision as a stepping stone for a regional, balanced framework, while Sirmione Mayor Luisa Lavelli praised the region’s openness to collaborative regulation and said the municipality will pursue sustainable tourism in tune with the community.
